Agreeing to these terms

These terms cover your use of the M&K Carlsbad Concrete and Masonry website and any estimate, quote or work we provide. By using this site, asking for an estimate or booking a job with us, you agree to them.

If you don't agree with these terms, please don't use the site or book work through it. If a signed written agreement for your job says something different from this page, the signed agreement controls for that job.

What we do

M&K Carlsbad Concrete and Masonry is a masonry contractor based in Carlsbad, CA. We also do concrete work. Our services include foundation repair, chimney and brick repair, tuckpointing, retaining walls, block and brick walls, pavers, walkways, stone veneer, fireplaces and outdoor kitchen masonry. We work in Carlsbad and the cities around it.

The service descriptions on our home page and service pages are general information about the trade and how we usually approach a job. They aren't a promise of a particular result on your property, because every house, soil and wall is different. The scope of your job is whatever your written estimate or agreement says. You can read more about our crew on our About page.

Estimates and pricing

Estimates are free and are done at your property, and there's no pressure to book. An estimate is our best judgment of the work and cost based on what we can see and what you tell us at that visit.

Some conditions only show up once the work is open, such as damaged block behind a wall face, poor soil or old repairs that have to come out. If that happens, we'll stop, show you what we found and explain the change in work and cost before we go ahead. We won't do extra work you haven't approved.

Unless your estimate says otherwise, it stays valid for 30 days, because material prices and our schedule change. Prices shown anywhere on this website are general information and are not a quote for your job.

Scheduling and cancellation

We set a start date with you once you accept the estimate. Weather, material delivery, permit timing and site conditions can move that date, and we'll tell you as soon as we know about a change. Masonry and concrete work in particular often waits on dry weather and curing time.

If you need to reschedule or cancel, please call us at (760) 496-5418 as early as you can. If we've already ordered special materials or started work, you may owe for those materials and any work completed, as set out in your written agreement. You also keep any cancellation rights that California law gives you.

Payment terms

Your written agreement lists the price, any deposit and when each payment is due. Larger jobs are usually paid in stages tied to finished parts of the work, so you're never paying far ahead of what's been done.

Final payment is due when the work in your agreement is complete, unless the agreement says otherwise. If a payment is late, we may pause work until it's caught up, and we may use the remedies California law allows a contractor to collect unpaid amounts.

Warranties and what they don't cover

We stand behind our work, and we want you happy with it when we leave. Any specific warranty on your job will be written into your agreement, and it covers only what it says.

Beyond that written warranty, and except where the law doesn't allow it, our work and this website are provided without other warranties, express or implied. A warranty doesn't cover damage from earthquakes, flooding, soil movement, tree roots, outside impacts, misuse, lack of upkeep or changes someone else makes to the work. Natural stone, brick and concrete vary in color and texture, and hairline cracks in concrete are normal as it cures, so those aren't defects on their own.

Limits on our liability

We carry insurance and are fully licensed, and we're responsible for the work we do. To the extent the law allows, M&K Carlsbad Concrete and Masonry isn't liable for indirect, incidental or consequential losses, such as lost rental income or the cost of staying elsewhere, and our total liability for any job is limited to the amount you paid us for that job.

We're also not responsible for errors or outdated details in the general information on this website, or for problems caused by conditions we couldn't reasonably see before the work started and that you chose not to have us address. Nothing on this page limits any liability that California law says can't be limited.

If we disagree

If something about your job isn't right, call us first. Most problems get settled quickly once we're back on site and can look at it together.

If we can't settle it that way, we both agree to try mediation with a neutral mediator before going to court. If mediation doesn't resolve it, either of us may take the matter to the courts in San Diego County, California.

Which law applies

These terms, and any work we do for you, are governed by the laws of the State of California, without regard to rules that would apply another state's law.

Changes to these terms

We may update these terms from time to time, and the version posted on this page is the one that applies. Changes don't affect a job already covered by a signed agreement unless we both agree in writing.

If you have a question about these terms, reach us through our contact page or call (760) 496-5418.
